Terms of Use

These Terms of Use ("Terms") are a legal agreement between you ("you" or "User") and Raviga Apps Private Limited ("we," "us," or "Company"), the operator of Miraquill — the website, mobile app, social/community features, publishing tools, and the AI Writing Assistant feature (together, the "Service").
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy and AI Writing Assistant Disclosure, which are incorporated here by reference. If you do not agree, do not use the Service.
1. What Miraquill Is
Miraquill is a social platform for writing and creative expression. It lets you write, edit, save, publish, share, and discover written work (poems, quotes, stories, captions, and other text), follow other users, comment, like, repost, and participate in community chat. It also includes an AI Writing Assistant (see Section 9).
Miraquill is intended for creative written expression. Please keep what you post and share in that spirit; for the kinds of content we encourage and our community standards, see our Community Guidelines.
We are an intermediary that hosts content created by users; we do not author or endorse user content.
2. Eligibility and Age (18+)
The Service is only for users who are 18 years of age or older. When you sign up, you must provide your date of birth; if you are under 18, you may not create an account or use the Service. By using the Service you represent that you are at least 18. We do not knowingly permit anyone under 18 to use the Service, and we may suspend or close accounts we believe belong to minors and delete associated data.
3. Your Account
You sign in using a third-party account (Google or Apple). You are responsible for keeping that account secure, for the information you provide to us, and for all activity under your Miraquill account. Notify us at support@miraquill.com if you suspect unauthorised use of your account. We may refuse, suspend, or terminate accounts as described in these Terms.
4. Your Content and Ownership
"Your Content" means anything you create, upload, post, publish, comment, or otherwise provide — text, drafts, posts, comments, images, and profile information.
You own Your Content, and we do not claim ownership of it. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, back up, reproduce, display, transmit, and — for content you choose to publish or share — distribute and make available Your Content, solely as needed to provide and maintain the Service. For public content this includes showing it to other users and visitors. For private content (e.g., unpublished drafts), we use it only to provide, secure, and support the Service. This licence ends when you delete the content or close your account, except for (a) content already shared/published publicly, (b) residual backup copies deleted in the ordinary course, and (c) anonymised/aggregated data.
You represent that Your Content is yours or that you have the rights to it, and that it does not infringe anyone's rights or violate any law.
Our intellectual property. The Miraquill name, logo, and the Service itself (including its software, design, and the materials we provide) are owned by us or our licensors and are protected by intellectual-property laws. You may not copy, modify, or use them without our prior written permission.
5. Community Rules and Prohibited Content
You must not post, share, generate, or transmit content that:
- is unlawful, defamatory, obscene, pornographic, paedophilic, invasive of privacy, or harmful to a child;
- is harassing, hateful, threatening, abusive, or promotes violence, self-harm, or terrorism;
- infringes any patent, trademark, copyright, or other intellectual-property or proprietary right;
- impersonates another person or is deceptive, misleading, or knowingly false;
- contains malware, or is spam, a scam, or fraudulent;
- discloses another person's private or personal information without authority;
- threatens the unity, integrity, defence, security, or sovereignty of India, public order, or friendly relations with foreign States, or otherwise violates any law in force.

6. Reporting, Moderation, and Takedown
- Reporting and grievances: You can report content or users in-app, or contact our Grievance Officer (Section 18). We will acknowledge a complaint within 24 hours and resolve it within 15 days of receipt.
- Removal of intimate imagery and impersonation: We will act to remove non-consensual sexually explicit material, or artificially morphed or impersonated images, within 2 hours of a valid complaint, as required by law.
- Legal orders: We will remove or disable access to content upon a valid court order or a notification by an authorised government agency, as required by law.
- Copyright/IP takedown: If you believe content infringes your IP, contact support@miraquill.com with details; we operate a notice-and-takedown process.
- We may remove content and suspend or terminate accounts for any actual or suspected violation of these Terms or applicable law. We do not endorse user content.
7. Acceptable Use of the Service
You agree not to: break any law; infringe others' rights; harvest or scrape data; upload malware or harmful code; interfere with, disrupt, probe, scan, or test the security of the Service or its systems, or breach or circumvent any security, authentication, or access controls; reverse engineer or extract source code, models, or technology except where the law permits; use cheats, bots, automation, or unauthorised third-party software; access non-public areas or systems without authorisation; circumvent limits, age restrictions, or payment controls; use automated access without permission; or use the Service to build or train a competing product or model.
Consequences. Violating this section may result in immediate suspension or termination of your account and forfeiture of any credits or subscriptions, without refund. Unauthorised access to or interference with our systems may also be a criminal offence under the Information Technology Act, 2000 (including Sections 43 and 66). We reserve the right to investigate, to recover the damages and costs we incur, to pursue all available legal remedies, and to report violations to law enforcement.
8. Advertising
The Service is supported in part by advertising (including Google AdMob). By default, ads may be personalized using your device's advertising identifier. You can opt out of personalized ads in the app's settings (you will still see non-personalized, context-based ads). See the Privacy Policy for details on advertising and identifiers.
9. AI Writing Assistant
The Service includes an AI Writing Assistant ("the Assistant"), presented in-app as miraquill_assistant. The Assistant is a writing tool only. It is powered by third-party AI providers (such as OpenAI and Anthropic), and your inputs are sent to them to generate responses; see our Privacy Policy for how that data is handled. It is not a human, and not a friend, companion, partner, counsellor, therapist, coach, confidant, or source of professional advice; it is not designed to form a personal or emotional relationship with you. It does not retain your conversations from one session to the next. Responses are AI-generated and may be inaccurate; you are responsible for reviewing and editing any Output before relying on or publishing it, and to the extent permitted by law we assign to you whatever rights we have in Output generated for you. We make no representation that Output is original, non-infringing, or fit for any purpose. The Assistant responds only to writing-related requests and will decline non-writing/emotional-support requests. See the separate AI Writing Assistant Disclosure for full details and limitations.
10. A Note on Wellbeing and Crisis Situations
The Service is a writing and social platform. It is not a crisis, emergency, counselling, or mental-health service and cannot help in an emergency. If you or someone else may be at risk, contact your local emergency services or a qualified professional/crisis helpline immediately. Do not rely on the Service in any urgent or unsafe situation.
11. Subscriptions, Payments, and Renewals
Some features require a paid subscription or credits. Pricing and terms are shown at purchase. Billing is handled by Google Play or the Apple App Store under their terms. Subscriptions auto-renew until cancelled; you can cancel anytime in your app-store settings (access continues until the period ends). Except where required by law or store policy, payments are non-refundable. We may change prices for future periods with notice where required.
12. Changes to the Service
We may add, change, suspend, or remove features at any time, and may impose limits or restrict access, without liability, where reasonable.
13. Disclaimers
The Service, all user content, and all Output are provided "as is" and "as available," without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant the Service will be uninterrupted, secure, or error-free, or that Output will be accurate or reliable. Where some warranties cannot be excluded by law, they are limited to the minimum the law permits.
14. Limitation of Liability
To the fullest extent permitted by law: we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or reputation. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) USD 50 (or the INR equivalent). Nothing excludes liability that cannot be excluded by law.
15. Indemnification
To the fullest extent permitted by law, you will indemnify and hold harmless the Company and its directors, officers, employees, and agents from claims, damages, losses, and reasonable costs (including legal fees) arising from (a) Your Content, (b) your use or misuse of the Service or Output, or (c) your breach of these Terms, any law, or any third-party right.
16. Suspension and Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive (including 4–5, 13–15, 17–18) survive termination.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. You agree that the courts at Delhi, India shall have sole and exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you submit to that jurisdiction and waive any objection to it.
18. Grievance Redressal
In accordance with the Information Technology Act, 2000, the Intermediary Rules 2021, and the Digital Personal Data Protection Act, 2023, you can raise a grievance with our Grievance Officer at membersupport@miraquill.com (the Grievance Officer is named in our Privacy Policy). We acknowledge grievances within 24 hours and resolve them within 15 days. For data-protection complaints you may also approach the Data Protection Board of India after exhausting our grievance process.
19. App Store Terms
If you download the Service from a third-party app store, you also agree to that store's terms. These Terms are between you and us, not the store; where required by the Apple App Store, Apple and its subsidiaries are third-party beneficiaries who may enforce these Terms.
20. General
These Terms (with the Privacy Policy and AI Writing Assistant Disclosure) are the entire agreement about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in a merger, acquisition, or sale of assets. We are not liable for delays/failures beyond our reasonable control.
